Terms of Use

Welcome to Happy Stories, operated by THE BREEZE TECH PTE. LTD. (“we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of the Happy Stories mobile application (“App”) and its related services, including but not limited to, photo and video uploads, printed gift purchases, and personal AI features (collectively, the “Services”). By accessing or using the App, you agree to comply with and be bound by these Terms. If you do not agree to any part of these terms, please discontinue the use of the App.

1. User Responsibilities

1.1 Acceptable Use of the App

You agree to use the App solely for lawful and personal purposes related to your family and children. Specifically, you agree to:

Only upload photos and videos of your family, children, and associated family activities.
Ensure content does not violate applicable laws, regulations, or third-party rights.
Only upload content that you own or have explicit permission to use.
Not upload harmful, offensive, defamatory, obscene, or inappropriate content.
Comply fully with all content guidelines and community standards provided by Happy Stories.

1.2 Age Restrictions and Parental Consent

The App and Services are intended for use by individuals aged 18 and above. If you are under 18, you may only use the App with the informed consent and active supervision of a parent or legal guardian, who assumes full responsibility for compliance with these Terms.

By uploading any content featuring minors, including photos, videos, or other personal data, you confirm that:

You are the legal parent or guardian of the minor, or have obtained verifiable parental consent; and
You authorize us to process such content in accordance with our Privacy Policy and applicable laws, including the Personal Data Protection Act 2012 of Singapore.

We do not knowingly collect personal data directly from children under 13 without parental consent. If we become aware that we have inadvertently collected such data without appropriate consent, we will take steps to delete it as soon as practicable.

1.3 User Account Creation and Maintenance

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete information during registration.
Maintain confidentiality and security of your login credentials.
Accept responsibility for all activities occurring under your account.
Immediately notify us of unauthorized account usage.

1.4 User Content Monitoring and Moderation

We reserve the right, but not the obligation, to monitor, screen, review, flag, filter, modify, refuse, or remove any User Content, in whole or in part, at any time and for any reason, including content that, in our sole discretion, violates these Terms, infringes on intellectual property or other rights, or is otherwise objectionable or harmful.

We may also suspend or terminate user accounts associated with such content or behaviours. However, you acknowledge and agree that we do not undertake any obligation to pre-screen content and that you use the Services at your own risk.
Happy Stories does not assume responsibility for the accuracy, integrity, quality, legality, or safety of User Content posted by users and disclaims all liability related thereto.

1.5 Reporting Abuse or Violations

If you encounter content or behaviours on the App that you believe violates these Terms or applicable laws, you may report it to us at: hello@happystories.io

We may, but are not obligated to, take action in response to your report, and you acknowledge that we are not required to disclose the outcome of our review or any related internal decisions. Repeated misuse of the reporting function may result in account restrictions.

2. Intellectual Property

2.1 Ownership and License of User Content

You retain all ownership rights in and to the content you upload to the App, including photos, videos, captions, and other materials (“User Content”).
By submitting or uploading any User Content, you grant Happy Stories and its affiliates a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, adapt, publish, translate, display, and distribute such content for the limited purposes of:
(a) providing, operating, maintaining, and enhancing the App and Services;
(b) fulfilling your orders (e.g., printed gifts);
(c) enabling personalization, search, and AI-driven features; and
(d) complying with applicable legal obligations.

This license continues for as long as your content is stored on the platform, and will survive the termination of your account only to the extent necessary to fulfil the purposes above or comply with legal retention requirements.

You represent and warrant that you have all necessary rights, licenses, and consents to upload and license the User Content and that doing so does not violate any third-party rights.

2.2 Company Intellectual Property

All content made available through the App and Services - other than User Content - including but not limited to text, design, images, illustrations, software, source code, algorithms, logos, trademarks, audio, and user interface components, is and shall remain the exclusive property of Happy Stories or its licensors.

Such content is protected by copyright, trademark, trade secret, and other intellectual property laws. You may not use, reproduce, distribute, modify, or create derivative works from any part of the App or Services without our express prior written consent. All rights not expressly granted under these Terms are reserved.

2.3 Copyright Infringement and DMCA Procedure

Happy Stories respects the intellectual property rights of others and expects its users to do the same.

If you believe that your copyrighted work has been copied, used, or made available on the App in a way that constitutes copyright infringement, you may notify our designated copyright agent by submitting a written notice containing the following:

A description of the copyrighted work you claim has been infringed;
A description of where the material you claim is infringing is located on the App (including a screenshot or URL, if available);
Your name, address, telephone number, and email address;
A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf; and
Your electronic or physical signature.

We reserve the right to remove content alleged to be infringing and to suspend or terminate the accounts of repeat infringers in appropriate circumstances.

3. Prohibited Activities

When using the App, you explicitly agree NOT to engage in or encourage any of the following prohibited activities:

Uploading content that infringes or potentially infringes on the intellectual property rights, including copyrights and trademarks, of the Company or any third party.
Violating or infringing upon the property rights, privacy, or portrait rights of others, including those of the Company or any third party.
Posting discriminatory, defamatory, or slanderous content aimed at damaging the reputation or credibility of any individual, the Company, or third parties.
Impersonating another person, misrepresenting your affiliation, or falsely suggesting partnerships or associations.
Engaging in or promoting activities that constitute or may lead to criminal offenses, including fraud, illegal gambling, drug abuse, child exploitation, trafficking, and other unlawful activities.
Uploading or disseminating obscene, pornographic, or abusive material, particularly involving minors.
Using the Service to solicit or promote sexual acts or explicit interactions.
Utilizing the App to meet or connect with individuals who are not known personally, for non-family purposes.
Posting graphic content depicting violence, cruelty, or scenes likely to cause distress or offense to others.
Establishing or promoting pyramid schemes, Ponzi schemes, or any fraudulent financial schemes.
Redirecting users to harmful websites, phishing sites, or sites containing malicious software, including merely setting up links to such locations.
Exploiting the Service for commercial profit or public dissemination beyond personal and familial sharing.
Unauthorized alteration, deletion, or manipulation of data stored on the Company's servers.
Transmitting or posting malicious software, including viruses or any form of malware.
Engaging in acts that place undue burden on the App’s infrastructure or interfere with its proper functioning and security.
Inducing or promoting suicide, self-harm, or any harmful behaviours towards others.
Violating applicable laws, regulations, public order, or morality in any jurisdiction.
Engaging in any other behaviours deemed inappropriate or disruptive by the Company.

Violation of these terms may result in suspension, termination, and potential legal actions.

4. Limitation of Liability

4.1 No Warranties

The App and Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by applicable law, Happy Stories and its affiliates, officers, directors, employees, agents, licensors, and service providers (collectively, the “Happy Stories Parties”) expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, or error-free functionality.

4.2 Content Integrity and Loss

You acknowledge and agree that use of the App and Services may involve the transmission of data over networks not owned or controlled by Happy Stories. As such, we do not guarantee the security or integrity of any data, content, or files uploaded or transmitted via the App. Happy Stories shall not be responsible for any loss, deletion, corruption, or failure to store any User Content. You are solely responsible for maintaining appropriate backups of your User Content.

4.3 Exclusion of Certain Damages

To the maximum extent permitted by applicable law, in no event shall the Happy Stories Parties be liable to you or any third party for any indirect, incidental, special, exemplary, punitive, or consequential damages, including but not limited to damages for loss of profits, goodwill, data, business interruption, or other intangible losses, arising out of or in connection with your access to or use of, or inability to access or use, the App or Services, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not Happy Stories has been informed of the possibility of such damage.

4.4 Limitation of Aggregate Liability

Without prejudice to the exclusions above, and to the extent Happy Stories is found liable under applicable law, the total liability of the Happy Stories Parties for all claims arising out of or relating to these Terms or your use of the App or Services shall not exceed the greater of:
(a) the amount paid by you to Happy Stories (if any) for the use of the Services in the six (6) months preceding the claim; or
(b) one hundred Singapore Dollars (SGD 100).

5. Termination

5.1 Termination Rights

We reserve the absolute right, at our sole discretion, to terminate or suspend your account or restrict access to the App without prior notice for any reason, including but not limited to violation of these Terms, misuse of the App, or compliance with legal obligations.

5.2 Effect of Termination

Upon termination, you will lose access to the App. Certain User Content may be retained to comply with legal obligations or as part of routine backup processes. Licenses granted under Section 2.1 survive termination.

6. General Provisions

6.1 Updates

We reserve the right to modify these Terms at any time to reflect changes in our practices or legal requirements. We encourage you to review these Terms periodically for updates. Continued use of the App after changes indicates acceptance of the updated Terms.

6.2 Governing Law

These Terms shall be governed and interpreted according to Singapore law. If the laws of your jurisdiction conflict with these Terms, Singapore law will govern to the fullest extent permitted by law.

6.3 Dispute Resolution

All disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Singapore courts.

6.4 Indemnity

You agree to indemnify, defend, and hold harmless Happy Stories, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:
(a) your access to or use of the App or Services;
(b) your violation of these Terms or any applicable law;
(c) your User Content, including any claim that it infringes or misappropriates any intellectual property or other rights of a third party; or
(d) your conduct in connection with the App or Services.

We reserve the right, at your expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us. You agree to cooperate with our defence of such claims.

6.5 Severability

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable for any reason, the remaining provisions shall remain in full force and effect and shall be construed in a manner that most closely reflects the original intent of the parties.

6.6 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements referenced herein, constitute the entire agreement between you and Happy Stories with respect to your use of the App and Services, and supersede all prior or contemporaneous agreements, understandings, or communications, whether oral or written, relating to the subject matter herein.

6.7 No Waiver

No failure or delay by Happy Stories in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, remedy, power, or privilege preclude any other or further exercise thereof. Any waiver must be in writing and signed by an authorized representative of Happy Stories to be effective.

7. Technology and Third-Party Services

7.1 AI Features Disclaimer

The App may include features powered by artificial intelligence (“AI”), including but not limited to image tagging, personalized suggestions, automated captions, or storytelling features. These AI tools are provided for informational and entertainment purposes only.

You acknowledge that:

AI-generated content may contain errors, inaccuracies, or biased outputs;
Such outputs do not constitute professional advice, endorsements, or representations by Happy Stories; and
You are solely responsible for verifying and evaluating the appropriateness of any AI-generated content before using or relying on it.

We expressly disclaim all liability for any loss or harm resulting from reliance on or use of AI features.

7.2 Third-Party Services and Links

The App may contain integrations, links, or access to third-party services, websites, or applications (“Third-Party Services”), including for payment processing, printing, delivery, and analytics.

These Third-Party Services are not under our control, and we do not endorse, monitor, or assume any responsibility for them. Your use of such services is subject to their respective terms and privacy policies, which we strongly recommend you review.

Happy Stories shall not be liable for any loss, damage, or inconvenience arising from your dealings with any Third-Party Services.

8. Data Privacy

Your privacy is important to us. Please refer to our Privacy Policy at (happystories.io/privacy) for detailed information on how we collect, use, disclose, and protect your personal data in accordance with applicable data protection laws, including the Personal Data Protection Act 2012 of Singapore (“PDPA”).

By using the App and Services, you acknowledge and agree that your personal data will be collected and processed in accordance with our Privacy Policy. If you submit or upload any personal data of others (including minors), you represent and warrant that you have obtained all necessary consents, including parental or guardian consent where required.

Our Privacy Policy forms an integral part of these Terms and is incorporated by reference.

By continuing to use Happy Stories, you confirm that you have read, understood, and agreed to be bound by these Terms of Use.
